In the wake of the devastating earthquake in Nepal, New Yorkers are encouraged to consider providing support to organizations assisting in relief efforts. The region faces countless challenges in the days, weeks and years ahead as individuals and families – many located in developing and rural areas – rebuild from the disaster. New York State is home to one of the largest Nepalese populations in America.

“Our thoughts and prayers are with the victims and their families affected by the devastating Nepal earthquake,” Governor Cuomo said in a statement. “As New Yorkers, we help our neighbors in their time of need, whether they are across the street, or across the globe.”

Consumers should be vigilant when donating money. Scam artists posing as charitable organizations take advantage of those willing to help in the aftermath of major disasters by stealing their money and robbing those who should truly receive assistance. Fraudsters commonly solicit money via telephone calls, mailings, social media posts and e-mails that lead to convincing, yet fake websites.

The New York Department of State’s Division of Consumer Protection tracks scams and provides assistance to the public by alerting and investigating apparent fraud.

The Division of Consumer Protection recommends taking the following precautions:

• Research the charity. Verify that the organization is registered with the Internal Revenue Service (IRS). Find out the charity’s mission, program and finances, as well as its experience and track record of success dealing with certain types of disasters in specific regions by searching the New York State Attorney General’s online database of registered charities at www.oag.state.ny.us, and by visiting websites such as www.bbb.org, www.give.org, www.charitynavigator.org and www.guidestar.org in addition to visiting the charity’s website.
• Designate your donation. Find out what percentage of your donation will directly go toward the cause as opposed to administrative costs. Ask the charity whether you can designate your donation to a specific effort rather than a general contribution fund.
• Resist high-pressure tactics. Watch out for direct e-mails from “victims” and solicitors who employ heart-wrenching stories, insisting that you donate immediately. It is strongly advised not to give money over the phone to unsolicited telemarketers, and instead ask the caller to send written materials about the charity.
• Do not disclose personal or financial information. Never give your Social Security number, credit card or debit card number or other personal identifying information in response to an unsolicited charitable request.
• Avoid giving cash. Give your contribution by check or credit card to ensure that you have a record of the donation. Make checks out to the charity, not to an individual. If you choose to make a donation via a charity’s website, check that the website is secure and that your computer is equipped with the latest anti-virus protection. Do not send contributions with a “runner,” by wire or overnight parcel pick-up.
• Don’t assume. Check an organization’s tax status at http://www.irs.gov/app/eos to find out if the donation is tax deductible.

Los consumidores deben estar atentos al donar dinero pues los estafadores haciéndose pasar por organizaciones de caridad se aprovechan de quienes están dispuestos a ayudar tras grandes catástrofes, robando su dinero y despojando a aquellos que verdaderamente deben recibir asistencia. Los defraudadores comúnmente solicitan dinero a través de llamadas telefónicas, el correo, mensajes en redes sociales y correos electrónicos que llevan a sitios web convincentes pero falsos.

El Departamento de la División de Protección al Consumidor del estado de Nueva York rastrea las estafas y ofrece asistencia al público alertando e investigando aparentes fraudes.
La División de Protección al Consumidor recomienda tomar las siguientes precauciones:

• Investigue a la organización benéfica. Verifique que esté registrada en la Hacienda Pública (IRS por sus siglas en inglés). • Asigne su donativo. Averigüe qué porcentaje de su donación irá directamente hacia la causa en comparación con los costos administrativos. Pregunte a la organización benéfica si puede asignar un donativo a un esfuerzo específico en lugar de a un fondo de contribuciones generales.
• Resista las tácticas de presión. Tenga cuidado con los correos electrónicos directos de “víctimas” y representantes que emplean historias desgarradoras, insistiendo en que usted debe donar inmediatamente. Se aconseja firmemente no dar dinero por teléfono a agentes de telemercadeo no solicitados, y en cambio pedirle a la persona que llama enviar materiales escritos acerca de la organización benéfica.

• No asuma. Verifique el estado de los impuestos de una organización en http://www.irs.gov/app/eos para averiguar si la donación es deducible de impuestos.
