Governor Andrew Cuomo broke federal and state harassment laws by sexually harassing multiple women, according to a devastating new report released by the office of New York State Attorney General Letitia James.
The eagerly awaited report is the result of a five-month investigation conducted by James’ office into allegations of sexual assault by Cuomo.
At a press conference on Tues., Aug. 3rd, James revealed findings of the investigation, which determined that Cuomo engaged in “unwanted groping, kissing, and hugging, and making inappropriate comments” to multiple women, including former and current state employees.
The report revealed a “deeply disturbing, yet clear picture” that Cuomo engaged in sexual harassment that violated both federal and state law as well as the Executive Chamber’s own written policies, James said.
“The Governor’s actions fostered a toxic workplace where staffers did not feel comfortable coming forward with complaints due to a climate of fear and of power dynamics,” she added.
According to the report, Cuomo and his senior staff took actions to retaliate against at least one former employee for coming forward with her story.
The Attorney General’s office launched its investigation in March after several women, including two former staffers, publicly revealed stories of sexual harassment by Cuomo.
“None of this would have been illuminated if not for the heroic women who came forward,” James remarked. “I’m inspired by all the women who came forward but more importantly, I believe them.”
James was joined for the press conference by Joon Kim and Anne Clark, the two independent investigators appointed by the Attorney General’s office to lead the probe.
They reviewed more than 74,000 pieces of evidence, including documents, emails, texts, audio files and photos, and also interviewed 179 witnesses, Kim said.
He discussed details from the report, which included numerous allegations of “unwelcome and non-consensual touching” against the Governor.
“The investigation revealed that these were not isolated incidents,” said Kim. “These were part of a pattern.”
The incidents were not limited to Cuomo’s own staff and extended to other state employees, including a state trooper on Cuomo’s protective detail, Kim said.
Clark referenced accusations made by former Cuomo aide Lindsey Boylan, who told investigators about numerous instances of sexual harassment from Cuomo, including a kissing incident in his office.
When Boylan reported the harassment to co-workers, the Governor’s staff created a policy that she should not be alone with Cuomo, in order to “protect the Governor,” Clark said.
“No one treated Ms. Boylan’s allegation seriously, other than to protect the Governor,” she said.
According to the report, key members of Cuomo’s staff shared disparaging information about Boylan with the press after she made public allegations of harassment. In addition, Cuomo’s staff also drafted an op-ed denigrating Boylan that was never published. These actions constitute unlawful retaliation, Clark said.
Cuomo was one of the witnesses interviewed for the investigation, providing 11 hours of testimony.
“There were certain things that he admitted to, but had a different interpretation of,” said Clark. “Other allegations, he denied or said he didn’t recall.”
“It was a mixture of admitting to certain things and putting a different spin on them, or denying them,” she said.
James said there would be no criminal charges related to the investigation stemming from her office.
“Our work is concluded. The document is now public,” she said. “The matter is civil in nature and does not have any criminal consequences.”
James said the report would be provided to the State Assembly, who is conducting its own inquiry into allegations against Cuomo that could set up a potential impeachment.
“As it relates to next steps, that’s entirely up to the Governor and the Assembly and the general public,” she said.
However, Clark suggested that criminal charges could still be a possibility, and said she believed one of the accusers might have had discussions with Albany prosecutors.
“Any prosecutor can look at the evidence and take action they believe is appropriate,” Clark said.
Though James and the investigators would not say whether Cuomo should resign or be impeached, several New York City elected officials quickly did so.
“Andrew Cuomo has acted for his entire career with abusive impunity, but his shamelessness cannot equate with immunity,” said New York City Public Advocate Jumaane Williams. “He created a culture of abuse which he has long employed to evade accountability, but the creation of that culture itself demands accountability. He cannot continue to serve as Governor and must resign immediately or be impeached expeditiously.”
“My first thoughts are with the women who were subject to this abhorrent behavior, and their bravery in stepping forward to share their stories. The Attorney General’s detailed and thorough report substantiates many disturbing instances of severe misconduct. Andrew Cuomo committed sexual assault and sexual harassment, and intimidated a whistleblower. It is disqualifying,” said Mayor Bill de Blasio in a statement.
“It is beyond clear that Andrew Cuomo is not fit to hold office and can no longer serve as Governor,” de Blasio said. “He must resign, and if he continues to resist and attack the investigators who did their jobs, he should be impeached immediately.”
In response to the report, Cuomo released a video in which he refuted the allegations.
“My attorney… has done a response to each allegation and the facts are much different than what has been portrayed,” Cuomo said. “I never touched anyone inappropriately or made inappropriate sexual advances.”
“First, I want you to know directly from me that I never touched anyone inappropriately or made inappropriate sexual advances. I am 63 years old. I have lived my entire adult life in public view. That is just not who I am and that’s not who I have ever been,” he said.
On the Governor’s website, Cuomo attorney Rita Galvin issued a point-by-point rebuttal of accusations against him.
In the document, Galvin wrote that the Attorney General’s report includes “unfair and inaccurate findings.”
“Regrettably, as the findings in the Report show, the investigators have directed an utterly biased investigation and willfully ignored evidence inconsistent with the narrative they have sought to weave from the outset,” Galvin wrote. “In coming to their conclusion, they ignored the Governor’s testimony and substantial corroborating evidence, and were not candid about that fact at a press conference during which they announced their findings.”
On Tuesday afternoon, Democrats in the State Assembly held an emergency meeting to review the James report.
Following the meeting, State Assembly Speaker Carl Heastie issued a statement.
“After our conference this afternoon to discuss the Attorney General’s report concerning sexual harassment allegations against Governor Cuomo, it is abundantly clear to me that the Governor has lost the confidence of the Assembly Democratic majority and that he can no longer remain in office,” Heastie said. “Once we receive all relevant documents and evidence from the Attorney General, we will move expeditiously and look to conclude our impeachment investigation as quickly as possible.”

En el documento, Galvin escribió que el informe de la fiscal general incluye “conclusiones injustas e inexactas”.

El martes por la tarde, los demócratas de la Asamblea Estatal celebraron una reunión de emergencia para revisar el informe de James.
Después de la reunión, el presidente de la Asamblea Estatal, Carl Heastie, emitió una declaración.
